على الرأي السائد في فقه القانون الجنائي، إن القسم الخاص من قانون العقوبات أسبق في الوجود من القسم العام، ذلك لأن القوانين القديمة أياً كانت درجة رقيها، فهي تشتمل على نصوص تجرم أفعالاً تشكل إعتداء على المصالح الإجتماعية السائدة، وتقرر لكل فعل من تلك الأفعال جزاء في صورة عقوبة يتناسب مع ضرر الجريمة أو مع خطورتها.
ويمثل رد الفعل الإجتماعي ضدها، ومع تقدم الدراسات القانونية وبلوغها درجة من النضج العلمي، صار الأمر إلى إستقراء نصوص القسم الخاص وإستنباط الأحكام التي تتميز بصفة العمومية، ثم جرى تأصيلها في قواعد عامة مجردة منها ما يطول الجرائم جميعها، ومنها ما يخص جرائم بعينها.
وبناء على ذلك يعتبر القسم الخاص مصدراً لقواعد القسم العام، يضاف إلى ذلك أن القسم الخاص يتميز بكونه الوسيلة إلى إخراج القسم العام من حال التجريد إلى مجال التطبيق، وإذا كان من خصائص القسم العام الثبات والإستقرار نظراً لعمومية قواعده وتجردها، فإن قواعد القسم الخاص عرضة للتعديل والتبديل، في نواحي الحياة كافة، وحيث إن هذه العلاقات تتغير مع الزمن والحاجة، فقد اقتضى الامر، أن يتدخل المشرع بين حين وآخر ليجعل التشريع ملائماً لواقع حال المجتمع وظروفه الجديدة.
على كل حال سندرس في هذا الكتاب الجرائم التي تقع على الإنسان، القتل والقصد والإيذاء القصد، والقتل والإيذاء من غير قصد وحرمان الحرية وخرق حرمة المنزل والتهديد وإفشاء السرم ثم الندم والقدح والتحقير، وجرائم العرض وهي جريمة الزنا والإغتصاب وهتك العرض والفعل المنافي للحياء.
