يضم قانون العقوبات نوعين من القواعد القانونية الموضوعية: قواعد عامة: وتضم القواعد التي تخضع لها الجرائم والعقوبات على إختلاف أنواعها، وتسمى هذه القواعد "قانون العقوبات القسم العام؛ قواعد خاصة: وتضم القواعد التي تحدد كل جريمة على حدة من حيث أركانها وعقوباتها والظروف الخاصة بها، وتسمى مجموعة هذه القواعد "قانون العقوبات / القسم الخاص".
وإذا كان القسم العام لقانون العقوبات يحظى بأهمية بالغة من الناحيتين النظرية والعلمية، بإعتباره القسم الذي يرسي الأصول العامة لقاعدة التجريم والعقاب، فإن القسم الخاص يقف في سلم الأهمية على نفس الدرجة بإعتباره القسم الذي يعطي بياناً بمفردات الجرائم والعقوبات المقررة لها.
وبناءً عليه، يدرس هذا الكتاب الجرائم المخلة بالثقة العامة، والجرائم المخلة لواجبات الوظيفة، ثم الجرائم الواقعة على الأشخاص، وتلك التي تقع على الأموال، وهي المسائل التي تعني الطلبة في كليات القانون العراقية كافة، مما يقتضي تقسيم الكتاب إلى أربعة أبواب لتغطية الموضوعات التي يشتمل عليها.
