نتناول في هذا الكتاب شرح جرائم الإيذاء المقصود سواءً ذات الوصف الجنحوي (الجنح) أو ذات الوصف الجنائي (الجنايات) وكذلك شرح جنح الإيذاء غير المقصود ثم بعد ذلك نتناول شرح جرائم القتل في صورها المختلفة: 1. القتل القصد والقتل القصد مع سبق الإصرار وقتل الفرع للأصل والقتل القصد المقترن بالجناية والقتل القصد المقترن بالجنحة والقتل الذي ترتكبه الأم على وليدها اتقاءً للعار والقتل الذي يقع أثناء مشاجرة جماعية ويتعذر معرفة الفاعل بالذات والقتل القصد المقترن بالعذر القانوني المخفف . 2. القتل غير المقصود (الذي يقع جراء الإهمال أو الطيش أو الرعونة أو عدم الاحتياط أو عدم مراعاة القوانين والأنظمة) وسوف نبين أن النص الواجب تطبيقه بالنسبة لحوادث القتل جراء حوادث السيارات وكذلك العاهات الدائمة، أصبح هو نص المادة (27) من قانون السير وذلك وفق ما استقر عليه اجتهاد محكمة التمييز في هذا الشأن . كما يشتمل هذا الكتاب على شرح جريمة الإجهاض سواءً في صورتها الجنحوية أو الإجهاض الجنائي (الجنايات) . كما يشمل أيضاً شرحاً لجرائم الاغتصاب وهتك العرض والمواقعة لأنثى لم تتم الثامنة عشرة من عمرها والمواقعة على خلاف الطبيعة (اللواط) والتي استحدثت بالقانون المؤقت رقم (12) لسنة 2010 ومع ملاحظة أن هذه الجريمة الأخيرة المواقعة على خلاف الطبيعة قد تم إلغاؤها بالقانون المعدل رقم (8) لسنة 2011 وقد صدر هذا القانون بعد شرح هذه المادة بالتفصيل وقد ارتأيت أن أبقى على شرحها في هذا الكتاب لغايات الفائدة العلمية رغم أنه ما عاد لها وجود بالقانون المطبق حالياً . ولن تقتصر الدراسة على الناحية الفقهية فقط وإنما ستكون معززّة أيضاً بالأحكام القضائية وعلى وجه الخصوص قضاء محكمة التمييز الأردنية. وسيكون هذا الكتاب في أربعة أبواب على النحو التالي : الباب الأول: جرائم الإيذاء ( المقصود وغير المقصود ). الباب الثاني: جرائم القتل ( المقصود وغير المقصود ). الباب الثالث: شرح جرائم استيفاء الحق بالذات ومقاومة الموظفين وأعمال الشدة التي تقع عليهم وجرائم الذم والقدح والتحقير والتهديد . الباب الرابع: شرح لجرائم الإجهاض وفض البكارة بوعد الزواج وجرائم الاغتصاب والمواقعة وجرائم هتك العرض والمداعبة والعمل المنافي للحياء والمواقعة على خلاف الطبيعة واللواط.
