تحظى قوانين إيجار الأماكن بأهمية بالغة لتعلقها بحاجة الإنسان إلى مسكن يأويهلا وأفراد أسرته, ومكان قد يباشر فيه نشاطه التجارى أو المهنى أو الحرفى, وقد أستهدف المشرع بالمادة 17 من القانون رقم 136 لسنة 1981 توفير وحدات سكنية نظراص لوجود الكثير منها مؤجرة اغير المصريين غير المقيمين بالبلاد وغير مستغلة مما اقتضى أن تنتهى عقود تأجيرها بانتهاء المدة المحددة قانوناص لإقامتهم بالبلاد, وبالنسبة للأماكن التى يستأجرها غير المصريين فى تاريخ العمل بأحكام هذا القانون الذى استحدث هذا النص أجازت المادة المؤجر أن يطلب إخلاءها إذا ما انتهت إقامة المستأجر غير المصرى بالبلاد.
كما استهدف المشرع فى المادة 2/22 من القانون رقم 136 لسنه 1981 تحقيق نوع من التوازن بين مصلحة كل من طرفى العلاقة الايجارية, فارتأى أنه مما يحقق العدل أن يخير المستأجر- الذى يقيم مبنى يتكزم من أكثر من ثلاث وحدات فى تاريخ لاحق لاستجاره- بين الاستغناء عن المسكن الذى يستأجره والاستعاضة عنه بآخر فى المبنى الذى أقامه أو الاحتفاظ به وتنفيذ التزامه بتوفير مسكن ملائم فى ذلك المبنى لأحد المستفيدين الذين حددهم نص المادة سالفة الإشارة, فإذا لم يستعمل النستأجر هذا الخيار الذى منحه له المشرع فإن ذلك يؤدى إلى الحكم بانتهاء عقد الإيجار وإخلاء العين المؤجرة له بناء على طلب مؤجرها.
ونظراً لأهمية المادتين 22,2/17 من القانون رقم 136 لسنه1981 لأن توافر شروط إعمال أى منهما يؤدى إلى انتهاء عقد الإيجار, ولكثرة المشاكل والمنازعات المتعلقة بتطبيقهما فقد جمعنا فى هذا المؤلف ونعرض لهما بالبحث فى ضوء الفقه وأحكام النقض.
