سبق أن أعددت مؤلفا ضمنته شرحا متعمقا لاحكام عقد الايجار، وتناولته وفقا لأحكام قوانين ايجار الاماكن المتعاقبة وأيضا وفقا لأحكام القانون المدني باعتباره القانون العام الذي يحكم هذا العقد بصفة أصلية موضحا أحوال تطبيقيه علي العقود التي أخضعتها قوانين ايجار الأماكن لاحكامها وعلي العقود التي اخرجتها تلك القوانين من نطاقها.
وفي الوقت الذي عزمت فيه علي طبع مؤلفي في شرح عقد الايجار صرح الوزير المختص بأعداد مشروع بقانون يتناول أعادة تنظيم المنازعات الايجارية، وأزاء ذلك، أرجأت النشر حتي يصدر القانون الجديد فأعيد التنقيح علي هدية.
ورأيت أصدار كتاب لا ينال منه الغاء القوانين أو تعديلها فكان كتابي المائل "عقد الايجار في ضوء قضاء النقض" وقد قمت بتبويبه علي نحو ييسر علي الباحث الوقوف علي ما يبغي من حكم المسألة محل النزاع، سواء الخاضع منها لاحكام قوانين ايجار الاماكن أو للقانون العام.
وجئت بأحكام النقض حتي عام 1986 مستبعدا المكرر منها مكتفيا بما سبق أن أورده بهذا الكتاب. ويقيني أنه سوف يكون خير عون لرجال القانون اذ توخيت فيه الناحية العملية، وأستبعدت الاحكام التي تقرر عدم نشرها.
