ينشأ الإلتزام عن أحد مصادره ، بسيطاً كما قد يكون موصوفاً ، إذا لحق أحد عناصر الرابطة القانونية أو محل الإلتزام أو أطرافه ، وصف ، وهذا الإلتزام قد ينتقل من جانب الدائن ، فيختفي الدائن الأصلي ويظهر دائن جديد ، ويسمى انتقال لإلتزام في هذه الحالة ، حوالة الحق . وقد ينتقل من جانب المدين ، فيختفي المدين الأصلي ، ويظهر مدين جديد ، ويسمى انتقال الإلتزام في هذه الحالة ، حوالة الدين .
ومهما طالت مدة الإلتزام لا بد أن يأتي يوم وينتهي أو قل ينقضي ، لأن الأصل ، براءة الذمة ، ولطرق الإنقضاء تصنيفات عديدة . فهناك طرق إنقضاء الإلتزام بتنفيذه عيناً بالوفاء أو بتنفيذه بما يعادل الوفاء أو بدون تنفيذه إطلاقاً ، وطرق انقضاء مباشرة وطرق انقضاء غير مباشرة وطرق انقضاء مبنية على تصرف قانوني وطرق انقضاء مبنية على واقعة مادية .
وهذا الكتاب مكرّس لدراسة أوصاف الإلتزام وانتقاله وانقضائه في القوانين المدنية العربية مقارناً بالفقه الإسلامي .
