يلعب العقد الإداري دورًا مهمًا في تسيير النشاط الإداري، حيث يمكن الإدارة من إنشاء واستغلال وصيانة المرافق العامة حتى تستطيع أن تؤدي خدماتها للمنتفعين بها، بصورة منتظمة ودائمة تحقيقًا للمصلحة العامة، وحيث أن العقد الإداري يقوم على فكرة تغليب المصلحة العامة على المصلحة الخاصة في حالة تعارضهما، فإن الإدارة العامة تتمتع وهي بصدد تنفيذه بسلطات واسعة تخل بمبدأ العقد شريعة المتعاقدين، كما فرض المشرع على الإدارة طرقًا معينة لإبرامه.
ونظرًا لما تتمتع بها العقود الإدارية من أهمية ونظام قانوني خاص، وحيث أنه لم تنظم العقود الإدارية في ليبيا بقانون خاص كما فعل المشرع في مصر، بل نظمت دائمًا بلوائح متعددة تصدرها السلطة التنفيذية، وتم تغييرها أكثر من خمس مرات خلال العقدين الماضيين، كان أخرها قرار اللجنة الشعبية (سابقًا) رقم 563 لسنة 2007 بإصدار لائحة العقود الإدارية الحالية، فقد رأينا إلقاء الضوء على هذه العقود من خلال دراسة تنصب على طرق انقضائها في القانون الليبي والقانون المقارن، ولقد آثرنا التركيز على الجوانب العملية لتلك العقود لما للجانب التطبيقي من أهمية، داعين الله جلت مشيئته أن ينفع بهذا العمل كل المشتغلين والمهتمين بالعقود الإدارية.
