أحكام الدعوى الجنائية وعقوبتها من المسائل الهامة من الناحية العملية، وخاصة الجانب المتعلق بانقضائها وسقوط عقوبتها، وتتناثر هذه الأحكام في ثناياً الإجراءات والبعض منها في قانون العقوبات، ولأهمية الموضوع رأيت أن أجمع شتات هذه الجزئيات في مؤلف واحد، مع تناول الجانب الفقهي وتحليل أحكام محكمة النقض، واستخراج المبادئ القانونية منها، حتى يسهل للباحث أن يجد الجزئية التي ينشدها، وقد ركزت على بعض المسائل العملية العامة، وعلى سبيل المثال تقادم الأحكام الغيابية، والتعليمات العامة للنيابات بشأن بعض المسائل العامة، وقد عالجت الجانب المقارن في بعض المسائل موضحاً موقف الفقه والقضاء الفرنسيين في هذا الصدد.
