إن المشرع بعد أن رأى مد العلاقة الإيجارية بحكم القانون بالنسبة لإيجار الأماكن لمدة غير معينة منعاً للملاك من إستغلال أزمة الإسكان، أراد حماية المستأجرين من الضغوط التى تقع عليهم من المؤجرين فوضع القيود على حق المؤجر فى طلب إخلاء المكان المؤجر وأورد الحالات التى يجوز له فيها إستعمال هذا الحق ومن بينهما تخلف المستأجر عن الوفاء بالأجرة ولك بعد إتباع إجراءات معينة قصد بها إحاطة المستأجر بضمانات لمنع تعسف المؤجر فى إستعمال حقه، كما أتاح للمستأجر الفرصة بتوقى الحكم بالإخلاء وذلك بسداد الأجرة المستحقة والمصاريف والنفقات. استحدث بالقانون رقم 52 لسنة 1969 سبباً جديداً للإخلاء هو تكرار إمتناع المستأجر أو تأخره عن الوفاء بالأجرة. ونظراً لأهمية الفقرة (ب) من المادة 18 من القانون رقم 136 لسنة 1981 وما تضمنته من حق المؤجر فى طلب إخلاء المكان المؤجر فى حالة عدم وفاء المستأجر بالأجرة أو تكرار إمتناعه أو تأخره فى الوفاء بها ولكثرة المنازعات المتعلقة بتطبيقها، فقد تعرضنا لسببى الإخلاء سالفى البيان فى هذا المؤلف بالإضافة إلى المسائل المتعلقة بنظر دعوى الإخلاء والحكم فيها وذلك فى ضوء الفقه وأحكام النقض.
وبعد... فهذه خطوة أخرى على الطريق أقدمها للزملاء المشتغلين بالقانون، راجياً أن يكون هذا الجهد محل تقدير، أما عن التوفيق فإنه من عند الله، إنه ولى التوفيق.
