تعد المحاكمة العادلة أحد الحقوق الأساسية للإنسان، وهي تقوم على توافر مجموعة الإجراءات التي تتم بها الخصومة الجنائية في إطار من حماية الحريات الشخصية وغيرها من حقوق الإنسان المتعلقة بها وضمانة أساسية لصون حقوق الإنسان وكرامته وشخصيته المتكاملة، ويثور البحث عن متطلبات حماية المجتمع حين يبدأ الإتهام وتقتضي مصلحة التحقيق إتخاذ بعض الإجراءات الجنائية في مواجهة المتهم.
وفي هذه الحالة تجدنا حيال نزاع بين قرينتين: قرينة قانونية على براءة المتهم، وقرينة واقعية على إرتكاب الجريمة، وكل من هاتين القرينتين تحمي مصلحة أساسية في المجتمع، فالأولى تحمي الحرية الشخصية للمتهم، والثانية تحمي المصلحة العامة، وعلى هذا سوف نتناول موضوع "حق الإنسان في محاكمة عادلة" في ثلاثة فصول على الوجه التالي:
الفصل الأول نبين فيه "الشرعية الإجرائية وحقوق الإنسان" ، الفصل الثاني نعالج فيه "ماهية المحاكمة العادلة" ، الفصل الثالث يتضمن أهم "ضمانات المحاكمة العادلة" .
