نظم قانون الإجراءات الجنائية المصري قواعد وضوابط الحبس الإحتياطي، والتي تناولها في تعديله الأخير الصادر بالقانون 145 لسنة 2006 والذي أدخل ضمانات هامة لحقوق المحبوس احتياطياً.
وقد عرضت لهذا الموضوع من خلال خطة قوامها تقسيم البحث إلى قسمين القسم الأول تناولت فيه التعريف بالحبس الإحتياطي وتنفيذ، من خلال عرض تعريف الحبس الإحتياطي اللغوي والتشريعي والفقهي، ومسمياته وتاريخه، وأهدافه، والتفرقة بينه وبين ما يشابهه من إجراءات، والعلاقة بينه وبين قرينة البراءة، وشروط صحة قرار الحبس الإحتياطي المتعلقة بالسلطة المصدرة له، وكذا الشروط الموضوعية والشكلية والإجرائية، وجزاء مخالفة هذه الشروط. وكذا القواعد الخاصة به في جرائم الأحداث، والنشر والصحافة، وأمن الدولة والكسب غير المشروع، والحبس الإحتياطي طبقاً لقانون الطوارئ، والجرائم التي تنسب إلى رجال القضاء ومن في حكمهم، وأعضاء البرلمان، والسلك الدبلوماسي والقنصلي.
كما تناولت الرقابة القضائية وغير القضائية على شرعيته، وتنفيذه والقواعد الدولية والقوانين الداخلية الخاصة بمعاملة المحبوسين احتياطياً، وتناولت في القسم الثاني انتهاء الحبس الإحتياطي والتعويض عن أضراره، وفيه عرضت للإفراج من حيث تاريخه، والإفراج الوجوبي، والإفراج الجوازي من حيث حالاته والسلطة والآمره به وشروط صحته وضماناته واستئنافه. وإعادة حبس المتهم احتياطياً والسلطة الآمرة به ومبرراته. والتعويض عن أضرار الحبس الإحتياطي من حيث خصم مدة الحبس الإحتياطي من العقوبة المحكوم بها والتعويض المادي والأدبي. ثم أعقبت ذلك بخاتمة للبحث وأهم التوصيات التي انتهيت إليها، وقامة بالمراجع.
