إذا كانت حقوق الإنسان وحرياته تكفلها القوانين والتشريعات العادية فإن السلطة هي التي تضعها، وتجعل لنفسها دوراً بارزاً في تنظيم الحقوق والحريات وحمايتها، وفي الدستور نجد قيوداً وضوابط على السلطة في ممارستها لمهامها، وفي تمتعها بامتيازاتها، وكفالة حقوق الأفراد وحرياتهم من ناحية أخرى؛ والصعوبة تكمن في إيجاد توازن بين هذين الطرفين؛ ويزداد الأمر صعوبة إذا علمنا أن السلطة هي الخصم والحكم.
ولعل أولى هذه الضمانات أن يكون الدستور نفسه جامداً، مستعصياً على التعديل في مسائل الحقوق والحريات إلا بالزيادة، وإضافة لهذا لابد من ضمانات تشريعية وأيضاً ما يقوم به القضاء من دور لا يستهان به في الرقابة على السلطة التنفيذية... وعليه سنتطرق في هذه الرسالة إلى ضمان حقوق الإنسان في ظل الدساتير الجزائرية، وذلك في فصل تمهيدي وأربعة فصول هي كالتالي (الضمانات الدستورية، الضمانات التشريعية، الضمانات القضائية، وأخيراً الرأي العام ودوره في ضمان الحقوق والحريات العامة).
