ينقسم قانون العقوبات إلى قسمين: قسم عام يحدد المبادئ العامة التي يخضع لها هذا القانون، وقسم خاص يبين الجرائم التي ينظمها القانون والعقوبات المقررة لها.
وتتمتع دراسة القسم الخاص من قانون العقوبات بأهمية خاصة من الناحيتين العملية والنظرية، ومن الناحية العملية يعتبر القسم الخاص من قانون العقوبات هو المصدر الذي استحدث فيه الأحكام العامة، ويكمن أهميته في وضع مبدأ الشرعية الجنائية موضع التطبيق العملي.
ومن الناحية النظرية، فالقسم الخاص من قانون العقوبات أسبق من حيث النشأة التاريخية من القسم العام، والتطور الذي يلحق القسم الخاص من قانون العقوبات يتأثر بالأخلاق والمصالح الإجتماعية، ويهدف إلى حماية هذه المصالح والقيم الإجتماعية.
وعليه، اختار المؤلف لهذه الدراسة نوعاً هاماً من الجرائم يتميز بأهميته القانونية وبكثرة تطبيقه في العمل، ودرسه وفق القانون المصري والقانون اللبناني، وعلى ضوء ذلك قسم دراسته إلى ثلاثة أقسام: القسم الأول: جرائم الإعتداء على المصلحة العامة، القسم الثاني: جرائم الإعتداء على الأشخاص، القسم الثالث: جرائم الإعتداء على الأموال.
