نص الشارع على جرائم الاعتداء على الأموال- السرقة, النصب, خيامة الأمانة- فى البابين الثامن والعاشر من الكتاب الثالث وهى التى تقع اعتداءا على الحقوق ذات القيمة المالية, وتتفق هذه الجرائم فى موضوعها وفى القصد من ارتكابها, فمحل الجريمة فى كل هذه الجرائم مال منقول مملوك للغير, اذ أنها تمثل اعتداء على حقوق للغير وعلى ماله ويعنى ذلك أنه يجب أن يكون الاعتداء فى هذه الجرائم صادرا عن غير صاحب الحق فيه وقصد الجانى فيها هو ضم هذا المال الى ملكه.
ترجع هذه التفرقة الى فعل الاعتداء على المال أى وسيلة الاستيلاء على هذا المال فهى تختلف من جريمة الى أخرى, ففى السرقة تكون الوسيلة هى انتزاع حيازة المال بغير رضاء مالكه, أما النصب فيحصل الجانى على المال من مالكه برضائه ولكن تحت تأثير طرق احتيالة, وفى خيانة الامانة تكون وسيلة الاستيلاء على المال هى تغيير الجانى نيته فى حيازة المال من حيازة وقتية أو ناقصة الى حيازة كاملة أى بهدف تملكه
وتنقسم دراستنا فى جرائم الاعتداء على الأموال الى ثلاثة أبواب يخصص الأول لدراسة جريمة السرقة, والثانى لبحث جريمة النصب أما الثالث فنخصصه لدراسة جريمة خيانة الأمانة.
