يقول الهندوس: إنَّ الإله الخالق ""براهما"" هو مَن وضع تشريعاته المقدسة وأوحاها إلى ""منو"" ليبلِّغها للناس، بينما يعتقد الباحثون بأن الآريين وضعوها لتكرّس دينياً سيطرتهم العسكرية الاستيطانية في الهند.
والمتمعِّن في توراة براهما، أو شريعته يجد فيها العجب، ففي بعض فقراتها ترتفع إلى أعلى درجات الحكمة والإنسانية، ثم نراها تنحطُّ في بعضها الآخر الى مستوى متدنٍّ من السخافة والخرافة، وتكريس ظلم لا يحتمل بحق طبقات المجتمع السفلى.
ولكي يتجاوز الهندوس هذه المفارقة يقولون: إنَّ الشريعة لا تناقش بمنطق البشر، ولا يمكن الاعتراض عليها بأي شكل. ونحن الآن يجب أن لا ننظر إلى هذه الشريعة بمقياس عصرنا، بل وفق زمانها حيث كانت لا يضاهيها تشريع في دقتها وتكاملها. وبغض النظر عن مصداقية الهندوسية أو عدمها، فنحن أمام أبكر مجموعة قوانين متكاملة أنتجها العقل البشري، والاطلاع عليها سيتيح لنا التعرف على نمط فريد من بدايات التفكير الديني القانوني الذي ربما كان أساساً لكل ما تلاه.
