تصنيف الشركات عادة بــ"شركات أشخاص" و "شركات أموال"؛ فالأولى يؤخذ فيها من جهة بالإعتبار الشخصي للشركاء، كما إن مسؤولية الشريك لا تقف عند حد كمية المال الذي يكون قد وضعها في تصرف الشركة للعمل، إنما تتعداه لتتناول كل ما يملكه الشريك، بحيث تشكل ضمانة أكبر لمسؤوليته التي تشمل أيضاً مسؤولية الشركة.
أما الثانية، فإن ما يؤخذ فيها بعين الإعتبار ليس الإعتبار الشخصي للشريك، إنما كمية المال التي يكون قد وضعها (الشريك) في تصرف الشركة، أي في "الرأسمال"، فيمحي إعتباره الشخصي بعد ذلك لتنحصر المسؤولية بمال الشركة وحدها، الذي يجسده رأسمالها.
هذا هو الحد الأهم الذي يميز هذين النوعين من الشركات، وتصنّف مع شركات الأشخاص، شركة التضامن، وشركة التوصية البسيطة، بينما تصنف مع شركات الأموال الشركة المساهمة المغفلة (ومن ضمنها الشركة القابضة وشركة الأوف شور) وشركة التوصية بالأسهم، وأما الشركة ذات المسؤولية المحدودة، فهي تستعير مقوماتها من كلا النوعين من الشركات، وتبقى الإشارة إلى أن شركات الأموال هي الأهم والأوسع إنتشاراً.
