تناولت هذه الرسالة موضوعاً مهماً من مواضيع المعاملات هادفة إلى بيان موقف الفقه الإسلامي من الشركة القابضة وما يتعلق بها من أحكام. وقد أظهرت الرسالة أن الشركة القابضة صورة جديدة من صور الشركات المساهمة وهي عبارة عن شركة مساهمة عامة تقوم بالسيطرة المالية والإدارية على شركة أو شركات أخرى تدعى الشركات التابعة إما بتملك أكثر من نصف رأس مالها أو أن تسيطر على تأليف مجلس إدارتها.
وقد توصل الباحث إلى أن الشركة القابضة يمكن أن تخرج على أنها شركة عنان لما بينهما من التشابه والقرب في الأصول والأركان العامة فلها شخصيتها المعنوية وذمتها المالية الخاصة بها، وبالتالي تجوز المساهمة فيها والتعامل بأسهمها بيعاً وشراءً، وتجب الزكاة في أموالها باعتبارها أموالاً نامية، وتخضع جميع تصرفات الشركة لنظرية التعسف في الشريعة الإسلامية، ويحرم على هذه الشركة أن تتعامل بالربا أخذاً وإعطاءً أو العمل فيما حرمه الله تعالى من الأعمال.
