لقد شملت دراسة "الحماية الدولية والشرعية لضحايا النزاعات المسلّحة" تأصيلاً لمصطلح "القانون الدولي الإنساني" مبيّناً أهمّ مبادئه وأحكامه وطبيعته القانونية والشرعية. وقد أظهرت أن اهتمام المجتمع الدولي بحقوق الإنسان زمن الحرب، خصوصاً بعد الحربين العالميّتين، الفضل في إصباغ الصفة الإنسانية على القواعد المتعلّقة بالقانون الدولي الإنساني.
كذلك تمّ في هذه الدراسة شرحاً عن تطوّر هذا القانون والمارحل التي مرّ بها وصولاً إلى اتفاقيات جنيف الأربع لعام 1949م وبروتوكوليها الملحقان بهذه الاتفاقيات لعام 1977م.
كذلك كان في هذه الدراسة تعريفاً بالقانون الدولي الإنساني في الإسلام شارحاً بيان مبادئه ومصادره ونطاق تطبيقه حسب المشروعية الإنسانية.
ثم شملت هذه الدراسة تطوّر مفهوم "قانون الحرب" في القانون الدولي التقليدي، والمراحل التي مرّ بها إلى مفهوم "قانون النزاعات المسلّحة" في القانون الدولي الحديث، وصولاً إلى مفهوم "القانون الدولي الإنساني".
ثمّ أظهرت اهتمام المجتمع الدولي والشريعة الإسلامية بالأشخاص والممتلكات والأموال أثناء النزاعات المسلّحة، فأقرًا الحماية اللازمة لضحايا هذه النزاعات.
لقد استخلصت من خلال هذه الدراسة أنه يرجع الفضل في استخدام مصطلح "القانون الدولي الإنساني" إلى اللجنة الدولية للصليب الأحمر. كذلك استخلصت أن الشريعة الإسلامية كانت السبّاقة في تطبيق الحماية اللازمة لضحايا النزاعات المسلّحة.
