يعتبر موضوع الحق في الحياة الخاصة أو الحق في الخصوصية من أهم موضوعات حقوق الإنسان في المجتمعات الحديثة، لما له من إرتباط وثيق بحرية الأفراد.
لذلك، قامت الدول حديثاً - ومنها لبنان - بالنص في دساتيرها وقوانينها على حقوق الإنسان وعن الحريات الخاصة له لما تراه مناسباً لديها.
لقد شملت هذه الدراسة شرحاً وافياً عن مفهوم الحياة الخاصة في الأديان الموحى بها، مفصلاً فكرة الحياة الخاصة في الشريعة الإسلامية، ثم بيّنت التطور التاريخي الوضعي لمفهوم الحياة الخاصة عند الأمم والمدوّنات القديمة وصولاً إلى إعلانات ومواثيق حقوق الإنسان الدولي والمحلية والتي تكلمت عن موضوع حرمة الحياة الخاصة.
كذلك شملت الدراسة الضمانات الشرعية والقانونية للحياة الخاصة، شارحاً ضمانات حرمة المسكن في الشريعة الإسلامية والقوانين الوضعية مع إجراء مقارنة بينهما، ثم تكلمت عن الضمانات الإجرائية الشرعية والقانونية مبيناً مكانة المتهم لدى كل منهما.
وقد استخلصت من هذه الدراسة أن الشريعة الإسلامية هي أول من أقرّت حقوق الإنسان بصفةٍ عامة، والحق في الخصوصية بصفة خاصة، وذلك يظهر جلياً من خلال إهتمام المجتمع الدولي بالحفاظ على حقوق الأفراد ومنها الحق في الحياة الخاصة في ميثاق الامم المتحدة وتحديداً الإعلان العالمي لحقوق الإنسان والمواطن الصادر عام 1948م.
