تعد مشكلة البيئة من المشكلات الدولية الحديثة نسبياً في تاريخ المجتمعات البشرية، فالمخاطر المحيطة بالبيئة وما يرافقها من تهديدات للإنسان والطبيعة لم تكن مثار إهتمام كبير إلا في الربع الأخير القرن الماضي بسبب الإدراك المتزايد بأن أي مساس بالبيئة لا تنحصر آثاره في مجال معين بل تمتد إلى مجالات عديدة أخرى.
ولقد واكب تصاعد الإهتمام بالدفاع عن الطبيعة وحماية البيئة على الأصعدة الوطنية، إهتمام بالغ على الصعيد الدولي، تمثل في مؤتمرات أسفرت عن عدد كبير من الإتفاقيات الدولية وإعلانات المبادئ انصبت جميعها على تأمين حماية أفضل للبيئة، وبالمقارنة فإن التطور في الإهتمام بمشكلة البيئة على الصعيد العالمي والفني لم يرافقه تطور مماثل على الصعيد القانوني على المستويين الوطني والدولي حيث أن هناك تفاوتاً واضحاً بين وقوع المشكلة البيئية على الصعيد القانوني، وعليه لم يدرك الفكر القانوني، مدى الحاجة إلى تنظيم قانوني لحماية البيئة إلا في وقت متأخر.
كما إن حداثة هذا الفرع من فروع القانون الدولي العام وقلة ما كتب عن هذا الموضوع باللغات العربية والأجنبية خاصة في المجال القانوني والطريقة التي تميزت بها كتابات القانونيين المختصين بالبيئة، حددت وإلى حد كبير أسلوب وخطة البحث التي اعتمدها الكتاب في الأساس من حيث تأجيل أحكام وقواعد هذا القانون إضافة إلى موضوع الحماية ومن ثم تحديد مسؤولية انتهاك هذه القواعد والأحكام، والتي في في مجملها تمثل النظام القانوني لحماية البيئة.
وقد شمل الكتاب على التطور الموضوعي من حيث الاهتمام وعلاقته بالإنسان والتنمية والأمن الدولي ومراحل تطور قواعد الحماية الدولية للبيئة في القرن الحالي وأخيراً التعريف بمفهوم القانون الدولي والمصطلحات ذات العلاقة.
