يعتبر القانون الدولي سقفاً تتحرك تحته الدول والأمم، ولا يجوز لأحد خرقه تحت طائلة المسؤولية، وإذا كانت القوانين العادية أو الخاصة، تعدل بعض الأزمات الطارئة، فإن القانون الدولي ينظم العلاقة بين الدول عبر إتفاقيات توافق عليها الأمم المتحدة بموجب ميثاقها.
وكل ذلك لم يمنع من الحروب الدولية والإقليمية، وإذا تجاوزنا الإطار النظري فإن في العالم الكثير من الأدلة والبراهين على خرق القانون الدولي وشرعة الأمم المتحدة، ولعل أقربها إلى الذاكرة، الحروب التي خاضها الكيان الإسرائيلي على شعب فلسطين وعلى شعب لبنان مرات عديدة وإيقاع الخسائر البشرية والمادية.
وفيها خرق فاضح للقانون الدولي الإنساني الذي ينص على حماية الأشخاص المتضررين في حالة النزاع المسلح، كما يهدف إلى حماية الأموال التي ليس لها علاقة مباشرة بالعمليات العسكرية.
وفي هذه الدراسة يتم تسليط الضوء على:
-القانون الدولي الإنساني وعلاقته بغيره من القوانين، هذا ما عالجته في القسم الأول.
-وفي القسم الثاني تطرقت إلى دور القانون الدولي الإنساني في حماية ضحايا الحروب.
-والقسم الثالث والأخير جاء تحت عنوان القانون الدولي الجنائي "المحاكم الجنائية الدولية والمحكمة الجنائية الدائمة".
