مجلة "القرارات الكبرى في الاجتهاد اللبناني والمقارن" تعني بنشر أهم الأحكام والقرارات الصادرة عن القضاء اللبناني والأجنبي بغية إيصالها إلى القارئ كل شهر. فهي إذاً مجلة شهرية. وإذا كانت التسمية تدل على عناية المجلة بالأحكام والقرارات، فمما لا شك فيه أنه قد اهتم بتخصيص ركن منها للتشريع، وآخر للدراسات القانونية، كلما دعت الحاجة وتيسر ذلك.
هذا ولم تقصر المجلة على قرارات محكمة التمييز وحدها، بل جمعت الأحكام والقرارات، سواء كانت صادرة عن قسم أو غرفة بدائية أو استئنافية أو مجلس شورى أو مجلس عمل تحكيمي أو محكمين.
المهم أن يكون الحكم أو القرار نموذجياً، يتضمن من المبادئ ما يشبع نهم القارئ ويعطيه الجديد والمستحدث من أفواه القضاة الناطقين بالقانون. ومن البديهي القول أن الأحكام والقرارات سوف تطال كافة الميادين من مدنية وتجارية وجزائية وتحكيمية وإدارية.
وبين يدينا العدد العشرون من هذه المجلة حيث يعرض لجملة من القرارات الصادرة عن المحاكم اللبنانية المتعلقة بـ: تنفيذ –عندما يتم، لا يعود من مجال لتوقيفه، تنفيذ – غير جائز بوجه شخص لم يصدر الحكم المنفذ بوجهه، تنفيذ حكم –واجب تقديمه من صاحب صفة ومصلحة، تنفيذ معجل –قرارات قاضي العجلة معجلة التنفيذ، حجز احتياطي –رفعة لقاء كفالة- عدم جواز إعادة وضع العقارات تحت أمر القضاء، حجز احتياطي –رفعه لقاء كفالة مبرزة أمام محكمة إفلاسية غير جائز، حجز احتياطي –غايته ضمان حقوق الحاجز وليس الإضرار بالمحجوز عليه، حجز احتياطي –كيفية ترجيح وجود الدين، دائرة تنفيذ –اختصاص مكاني- تحديده- قيمة الحجز- عدم جواز تخفيضها، رد طلب وقف تنفيذ –كيفية استئناف قرار الرد، رفع الحجز الاحتياطي يخضع للرسم النسبي، مشكلة تنفيذية –رد طلب وقف تنفيذ رغم الخطأ في اسم المنفذ عليه-مصيره، مشكلة تنفيذية –مدى رقابة دائرة التنفيذ لمنطوق القرار.
