مجلة "القرارات الكبرى في الاجتهاد اللبناني والمقارن" تعني بنشر أهم الأحكام والقرارات الصادرة عن القضاء اللبناني والأجنبي بغية إيصالها إلى القارئ كل شهر. فهي إذاً مجلة شهرية. وإذا كانت التسمية تدل على عناية المجلة بالأحكام والقرارات، فمما لا شك فيه أنه قد اهتم بتخصيص ركن منها للتشريع، وآخر للدراسات القانونية، كلما دعت الحاجة وتيسر ذلك.
هذا ولم تقصر المجلة على قرارات محكمة التمييز وحدها، بل جمعت الأحكام والقرارات، سواء كانت صادرة عن قسم أو غرفة بدائية أو استئنافية أو مجلس شورى أو مجلس عمل تحكيمي أو محكمين.
المهم أن يكون الحكم أو القرار نموذجياً، يتضمن من المبادئ ما يشبع نهم القارئ ويعطيه الجديد والمستحدث من أفواه القضاة الناطقين بالقانون. ومن البديهي القول أن الأحكام والقرارات سوف تطال كافة الميادين من مدنية وتجارية وجزائية وتحكيمية وإدارية.
وبين يدينا العدد الأربعون من هذه المجلة وفيه قرارات صدرت عن المحاكم اللبنانية المتعلقة بـ: إجارة -حق تنظيم العقد يعود لأصحاب أكثرية ثلاثة أرباع الحصص، إجارة -مفهوم وشروط ترك المأجور، إجارة -أجنبي- ترك المأجور- شروط الإسقاط المنصوص عليه في البند (ح)- مفهوم المادة 23 من القانون رقم 160/92، استملاك -تعويض- شروط الحكم به- تشويه بسبب مرسوم آخر- لا تعويض عنه، إسقاط حق -مفاعيله- قانون العفو- آثاره، إعادة محاكمة -قبولها رغم تصريح طالب الإعادة أنه لم ستبلغ الحكم إلا أنه أرفق بطلبه صورة مصدقة عنه، مما يغني عن كل معاملة أخرى للقول بحصول التبليغ، تحكيم -طعن بطريقة الإبطال -القرار الاستئنافي يقبل التمييز، تعسف في استعمال حق الطعن في الميدان المدني، تفسير الأحكام الجزائية -هل يجوز تفسير الشق المتعلق بدعوى الحق الشخصي؟، تنفيذ عقد مخالصة- صورة العقد، حكم أجنبي -منحه الصيغة التنفيذية -وجوب إرسال الإنذار مسبقاً، سرقة موصوفة -كسر باب المنزل ودخوله، سلفة وقتية -شروط منحها، قسمة -حصولها بموجب قرار -شطب إشارة هذا القرار، قانون العفو -أحكامه تتعلق بالنظام العام، واجب المحكمة تطبيقها عفواً.
