مجلة "القرارات الكبرى في الاجتهاد اللبناني والمقارن" تعني بنشر أهم الأحكام والقرارات الصادرة عن القضاء اللبناني والأجنبي بغية إيصالها إلى القارئ كل شهر. فهي إذاً مجلة شهرية. وإذا كانت التسمية تدل على عناية المجلة بالأحكام والقرارات، فمما لا شك فيه أنه قد اهتم بتخصيص ركن منها للتشريع، وآخر للدراسات القانونية، كلما دعت الحاجة وتيسر ذلك.
هذا ولم تقصر المجلة على قرارات محكمة التمييز وحدها، بل جمعت الأحكام والقرارات، سواء كانت صادرة عن قسم أو غرفة بدائية أو استئنافية أو مجلس شورى أو مجلس عمل تحكيمي أو محكمين.
المهم أن يكون الحكم أو القرار نموذجياً، يتضمن من المبادئ ما يشبع نهم القارئ ويعطيه الجديد والمستحدث من أفواه القضاة الناطقين بالقانون. ومن البديهي القول أن الأحكام والقرارات سوف تطال كافة الميادين من مدنية وتجارية وجزائية وتحكيمية وإدارية.
وبين يدينا العدد الثالث والأربعون من هذه المجلة وهو يعرض لجملة من القرارات الصادرة عن المحاكم اللبنانية وناقشت الدعاوى التالية: إيجار –وفاة المستأجر الأصلي- استفادة أولاده من حق الإيجار، إجارة صيفية –لا تمديد- إشغال دون مسوغ شرعي- إخلاء، إجارة –تنظيمها من قبل مالك ربع الحصص- باطلة، إيجار – ترك المأجور- توافر شروطه القانونية- فسح العقد، بيع عقاري –لا مفعول له إلا من تاريخ قيده، تحكيم –تمثيل تجاري –قرار تحكيمي- قوته التنفيذية، تعويض عن أضرار لحقت بالمدعين جراء مقتل مورثهم أمام القضاء المدني، تمييز –تحديد قيمة المدعى به عند تقديم الدعوى البدائية، تنفيذ –اعتراض- شروطه –حجز احتياطي- تحوله إلى تنفيذي- آثاره، تنفيذ تعهد –للغير أن يستشكل إذا كان التنفيذ يضر بحقوقه، زواج –فسخه من قبل محكمة محل إقامة الطرفين- عدم جواز الاعتراض على القرار، مصالحة –عدم طرحها من قبل المحكمة الشرعية لا يشكل مخالفة ترتب البطلان، مقاصة بين حسابات مصرفية –جواز المطالبة بها من قبل العميل، مؤسسة تجارية –وجودها وانتقاؤها –أهمية عنصر الزبائن، نقل جوي دولي –شروط الاحتجاج- مسؤولية الناقل.
