يعتبر استيقاف الأشخاص أحد الإجراءات التي يلجأ إليها رجال السلطة العامة من أجل كشف الجرائم وتعقب الجناة الذين انزلقوا إلى سلوك سبيل الإجرام، ورغم أنه يمس بحرية الأفراد في الحركة والتنقل، إلا أنه وفق بعض قوانين الإجراءات الجنائية المقارنة إجراء ضروري ولا يمكن الإستغناء عنه في عمل أجهزة الضبط في الدولة، ومن ثم تُثار بالنسبة له المشكلة الأبدية في كيفية التوفيق بين ممارسة الأفراد لحرياتهم وحفظ الأمن والنظام في المجتمع. ولعل عدم نص بعض القوانين الإجرائية الجنائية العربية، على هذا الإجراء، أمراً يثير صعوبة جدية في مسألة الموازنة بين حقوق الإنسان والنظام العام في المجتمع، خصوصاً وأن بعض القوانين التي صدرت حديثاً كقوانين (مكافحة الإرهاب) قد تذهب فيها السلطة المختصة عند تطبيقها على الأفراد إلى ممارسة إجراءات الإستيقاف عليهم دون علمهم بماهية هذا الإجراء ودون وجود ضمانات نص عليها المشرّع لحماية حرية الأفراد من التعسف عند استيقافهم، لذا يقدم هذا الكتاب دراسة وافية عن موضوع الإستيقاف من خلال تقسيم الدراسة فيه إلى ثلاثة فصول: يتناول الأول ماهية الإستيقاف والمشتبه فيه، ويبحث الثاني ضمانات المستوقف، أما الثالث فرصدناه للإستيقاف غير المشروع والمشؤولية الناشئة عنه.
