تشكل دراسة الضمان أهم الدراسات الشرعية والقانونية، فالضمان تترتب عليه آثار مهمة، وأحكامه خطيرة، لكن معالمه غير واضحة، وإن كانت الدراسات الشرعية قد حاولت جمع شتات مفرداته وجمع معانيه في كتب ومجلدات، لكن لم يسع أحد - على حد علمنا - من رجال القانون إلى وضع المعالم العامة لهذا الموضوع المهم، الذي يأتي تارة بمعنى الإلزام أو الإلتزام، كالإلتزام بضمان التعرض والإستحقاق والإلتزام بضمان العيوب الخفية، وقد يأتي بمعنى التعويض المترتب على نهوض المسؤولية المدنية بصورتيها (العقدية والتقصيرية)، وقد يأتي بمعنى التأمين، كالتأمين الإجتماعي (الضمان الإجتماعي) للعمال والموظفين وما إلى ذلك، أو نعني به التأمين الخاص بضمان حصول الدائن على حقه، وهو قد يتمثل في الضمان العام للدائنين أو في الضمان الخاص، والذي يقسم إلى ضمان شخصي (الكفالة) أو ضمان عيني (كالرهن أو الإمتياز).
