أهم الضمانات التي يتمتع بها القاضي في الشريعة والقانون، سواء أكانت ضمانات مادية أم معنوية، وأوضحت أنَّ الضمانات المعنوية للقاضي تشمل كل ما يتعلق بالجانب المعنوي، مثل: الاستقرار الوظيفي، واستقلال السلطة القضائية عن السلطتين التشريعية والتنفيذية، وعدم النقل التعسفي، والانتداب، والترقية، ووجود مجموعة من الحصانات القضائية الكفيلة بحماية القاضي من أي اعتداء أو تدخل، والاحترام الأدبي للقضاة.أما الضمانات المادية للقاضي، فهي تشتمل على كل ما يتعلق بالجانب المادي، مثل: الراتب الوظيفي، وما يمنح للقضاة من مكافآت وحوافز وترقية، وأوضحت هذه الدراسة دور الضمانات الممنوحة للقاضي في إعطائه مزيداً من الثقة بالنفس، ومزيداً من الإخلاص والحياد والتفاني في العمل القضائي، وبالتالي تحقيق العدالة للجميع، وتحقيق مقاصد تولّيه القضاء، والتي أهمّها إنصاف المظلوم، وإيصال الحقوق لأهلها، وانتهت الدراسة إلى بعض النتائج والتوصيات، واستعان الباحث بمنهج التأصيل والمقارنة في هذه الدراسة، إضافة إلى المنهج العلمي القائم على الاستقراء والتحليل ضمن المنهجية العلمية
