لا يكفي أن يقع على عاتق قانون العقوبات ضمان حق الحياة، بل لا بد أن يضمن أيضاً الحق في ممارسة هذه الحياة، فالمصلحة التي يحميها قانون العقوبات في جرائم القتل هي مصلحة (حق) الحياة، أما المصلحة التي يحميها في جرائم الإيذاء والجرح وإعطاء المواد الضارة فهي مصلحة (حق) الإنسان في التكامل الجسدي، فالتكامل الجسدي مصلحة يعترف بها قانون العقوبات لكل فرد من أفراد المجتمع ويقرر لها الحماية المطلوبة التي تنسجم وركائز السياسة الجنائية لكل بلد وتتمثل هذه الحماية بتجريم كل إعتداء أو سلوك ينال من هذه السلامة وذلك بتعريض أعضاء جسم الإنسان للتلف أو الإنتقاص من الأداء الطبيعي لوظائف هذه الأعضاء بغض النظر عن الوسيلة التي يتحقق بها هذا الإعتداء سواء كانت جرحاً أو ضرباً او أعطاء مواد ضارة أو أي فعل آخر مخالف للقانون، وعلى ذلك فإن أي عدوان على جسم الإنسان من شأنه النيل من قدرات الأعضاء في أداء وظائفها يجرمه القانون وإذا كان الفرد رأس مال المجتمع فإن هذا الإعتداء لا يوصف بأنه إعتداء ينال من الشخص الذي وقع عليه الإعتداء فقط بل يمتد أثره لينال عموم المجتمع، ومعنى ذلك أن حق الإنسان في سلامة جسمه ليس حقاً فردياً فقط بل هو حق جماعي لأن من حق المجتمع أن يقوم كل عضو فيه بأعباء وظيفته الإجتماعية ولا نتصور إمكانية وقدرة الوفاء بهذا الواجب ألا إذا تمتع الفرد بقدر عال من السلامة والصحة التي تؤهله للقيام بذلك وإن أي إعتداء ينال من هذه السلامة والصحة سيقلل من قدرة الفرد في القيام بما يتطلبه هذا الواجب، وهذا ما يكعس مدى الترابط بين هاتين المصلحتين، مصلحة الفرد في سلامة جسمه من جانب ومصلحة المجتمع في أن يؤدي كل فرد فيه واجبه ووظيفته الإجتماعية على وجه متكامل من جانب آخر.
