تبدو أهمية القانون الجنائي في حماية القدر الضروري من المصالح المشتركة للجماعة وتوفير الطمأنينة لهم وتحقيق العدالة. ولكن هناك جرائم مضرة بالمصلحة العامة وجرائم مضرة بمصلحة الأفراد وخلال تطور الفكر الإنساني تطورت النظرة لأنواع الجرائم أو تسميتها وكان من بين هذه التسميات "الجرائم الاجتماعية" كما عبر عن ذلك قانون العقوبات العراقي في الباب الثامن منه.
وهذا الكتاب يقف على هذا التنوع من الجرائم خلال ثلاثة مراحل 1- العصور البدائية والقديمة، 2- المرحلة الثانية تمثل الشريعة الإسلامية وأحكامها، 3- جرائم العصر الحديث، كذلك يتتبع الكتاب المدارس الفكرية التي سلطت الضوء على أسباب الجريمة سواء المدارس التقليدية أم الحديثة. ولكن، لا تكتفي الدراسة بالأسباب النظرية بل اهتمت بالجانب التطبيقي ودرست آثارها على الأرض وفي المجتمع واعتبرتها اختراقات تهدد أمن المجتمع. من هنا جاء دور المشرع في مدى مواكبته التطور الحاصل للتعبير عن العقاب بصيغة النصوص العقابية، إضافة إلى إلقاء الضوء على ما يعج به المجتمع العربي والعراقي خاصة بهذا النوع من الجرائم.
ما يريد أن يقوله الكاتب أن مثل هذه الجرائم يتم أحياناً التفاضي عن قرارات قضائية بشأنها "رغم أن المجتمع يكاد يحصي الآلاف منها يومياً" "..لكن اعتبارات المجتمع وتخلف قيمه قد تملى عدم الاكتراث بمرتكبيها..." لذلك وجب دراسة النصوص بأسلوب جديد يستلزم ".. علاجاً ومعاملة عقابية خاصة كبديل للعقاب بمعناه وأسلوبه التقليدي إضافة لكون بعض هذه الجرائم من عداد المخالفات التي تنفرد بأحكام موضوعية وأخرى شكلية مقارنة بالجنايات والجنح".
