تنص القوانين المرعية في كل دولة من دول العالم على أنه لا بد للحق من حماية، وتتمثل حماية الحق العيني بتمكين صاحبه من مباشرة السلطة التي يقرها له القانون على الشيء الذي يرد عليه وهي حماية سهلة. أما حماية الحق الشخصي فيبدو أكثر صعوبة، ذلك لأن التزام من عليه الحق الشخصي لا يتسنى تنفيذه إلا بواسطة المدين. وقديماً أسرف الرومان في القسوة على المدين في سبيل حماية الدائن حتى أنهم أباحوا استرقاق المدين وقتله.
وقد تأثر القانون السوري القديم بهذه الفكرة، فأجاز الإكراه البدني، عندما سمح للدائن بحبس مدينه المماطل. ولكن قانون أصول المحاكمات السوري الجديد لعام 1953، قد ألغى الإكراه البدني في المواد المدنية، وقصر السماح به على الأحوال الشخصية وحالة التعويض عن الأضرار المتولدة عن جرم جزائي، ويعني إلغاء الإكراه البدني في التشريع السوري أن المشرع قد جنح إلى اعتبار مال المدين، لا شخصه، مسؤولاً عن الوفاء بدينه.
وفي هذا الكتاب دراسة قانوينة مستفيضة تتناول دراسة الحقوق العينية التبعية حسب مصدرهما. وقد عمد الدكتور محمد وحيد الدين سوار في دراسته هذه إلى أولاً: دراسة الحقوق العينية التبعية حسب مصدرها، فبدأ بدراسة التأمينات الاتفاقية بما في ذلك الرهن التأميني الرضائي والرهن الحيازي، ثم التأمينات القانونية وشمل ذلك الرهن التأميني الجبري وحقوق الامتياز. وتبعاً لذلك تمّ تقسيم الكتاب إلى قسمين شمل القسم الأول التأمينات الاتفاقية، وتمّ تخصيص القسم الثاني للتأمينات القانونية. والكتاب موجه إلى طلاب الحقوق في الجامعة السورية، إلا أن فائدته تشمل الدارسين والعاملين والباحثين في الحقول القانوية بصورة عامة.
