من خصائص الرهن أنع تابع للدين المضمون، فالرهن يرتبط بالدين المضمون ارتباط التابع بالمتبوع، فالدين هو الأصل، والرهن فرع، والفرع يتبع الأصل.
فمن القواعد المعروفة أو المشهورة في الفقه الإسلامي قاعدة: "التابع تابع ومن تطبيقاتها أو فروعها الكفالة والرهن فكلاهما تابع للدين المضمون.
والذي دفعني للكتابة في مسألة تبعية الرهن للدين المضمون هو أن الكلام عن هذه المسألة يستلزم في عدة مسائل مهمة هي: (مدي تبعية الرهن للدين المضمون، وهل هي مطلقة أم نسبية، ارتباط الكلام عن مدي تبعية بالتكييف القانوني للرهن، هل تستلزم هذه التبعية أن يوجد للرهن بعد وجود الدين أم يمكن أن يوجد معه أو قبله، هل انتقال الدين عن طريق الحوالة يستتبع نقل الرهن أيضاً، انقضاء الدين يستتبع انقضاء الرهن إذا توافرت شروط معينة، كما أن يكون عودة الدين تستتبع عودة الرهن).
وقد كانت طريقتي في الكلام عن هذا الموضوع هي بيان حكم المسألة في كل من الفقه الإسلامي والقانون المدني، ثم أوازن بعد ذلك بين الفقه الإسلامي والقانون المدني.
وفي غالب الأحوال كنت أبدأ ببيان حكم المسألة في القانون المدني ثم حكمها في الفقه الإسلامي، وفي بعض الأحيان بينت حكم المسألة في الفقه الإسلامي أولاً ثم حكمها في الفقه الإسلامي، إما لأن الفقه الإسلامي قد عرض للمسألة بشكل مفصل كما هو الحال مثلاً في معني الدين، وفي بعض أسباب انقضاء الدين المضمون وأثرها علي الرهن، أو أن حسن عرض المسألة يقتضي ذلك.
وقد يقتضي طبيعة هذا البحث أن أقسمه إلي: فصل تمهيدي، وفصلين آخرين وخاتمة، (تعريف كل من الدين والرهن، معني تبعية الرهن للدين المضمون ومدي هذه التبعية، الآثار التي تترتب علي تبعية الرهن المضمون، الخاتمة تضمن أهم نتائج البحث).
