"لا يغلق الرهن من صاحبه الذي رهنه له غنمه وعليه عرمه" فقد وضع الحديث الشريف أساسا لتعامل الدائن مع العين المرهونة، وعلاقة المدين بها وأن الرهن لا يحول بين العين وبين صاحبها فغلاله وزوائده، ونماؤه ومنافعه من حقه. فهو ملكه ولم يغلق الرهن بين ده وبينه بالرغم من إقباضه للدائن وحيازته له.
ومن هذا الأساس ينطلق هذا البحث الذي سسيخوض في آثار الرهن بالنسبة للدائن المرتهن من حيث واجباته وحقوقه.. دراسة مقارنة بين المذاهب الفقهية، وبيان موقف القانون المدني من هذه الموضوعات، ومدى اتفاقه واختلافه مع أحكام الشريعة الإسلامية، وقد قسمت هذا البحث إلى فصل تمهيدي وثلاثة فصول.
نتناول الفصل التمهيدي في مبحثين: المبحث الاول: في حقيقة الرهن في الفقه الإسلامي والقانون المدني، المبحث الثاني: في أهمية القبض ودوره في الرهن في الفقه الإسلامي والقانون المدني.
ثم أتناول في الفصل الأول: آثار الرهن الحيازي على المرتهن بعد قبض المرهون، في المبحث الأول: أوضح من يقوم بقبض المرهون، المبحث الثاني: أبين واجبت المرتهن على العين المرهونة حيازيا. من حيث: التزامه بحفظ المرهون والانفاق عليه، ومن حبث: انتفاعه بالعين المرهونة. ثم في مبحث ثالث: أتعرض لحكم تصرفات المرتهن في العين المرهونة خلال أجل الدين، وفي مبحث رابع: مسئولية المرتهن في رد العين المرهونة بعد الوفاة، وفي مبحث خامس: واجب المرتهن في رد العين المرهونة بعد الوفاة.
وفي الفصل الثاني: أبين وسائل المرتهن لاستيفاء الدين من محل الرهن، في المبحث الأول: مدى صحة تملك المرتهن للمرهون كأمر مفروض على الراهن، وفي المبحث الثاني: بيع المرتهن للمرهون لمجرد حلول الأجل، وفي المبحث الثالث: أتعرض للوسائل الشرعية لاستيفاء المرتهن لدينه، وفي المبحث الرابع: في حق الدائن المرتهن في طلب بيع المرهون.
ثم في الفصل الثالث: أتحدث عن انقضاء الرهن لسبب المرتهن، في مبحث أول: أتحدث عن انقضاء الرهن بصفة أصلية، ثم في مبحث ثان: عن انقضاء الرهن بصفة تبعية، ثم خاتمة البحث وخلاصته.
