تتناول هذه الدراسة موقف القانون المدني الأردني في الاتجاهات العامة في المدونات الحديثة، وأهمها: مبدأ سلطان الإرادة، والنزعة الموضوعية والنزعة الذاتية، ونظرية الإرادة الظاهرة والإرادة الباطنة، ومدى توسع سلطة القاضي، والنزعة الفردية والنزعة الجماعية. كما تتناول مسألتين بالغتي الأهمية هما: مسألة رفض التعويض عن التأخير في القانون المدني الأردني والحلول المقترحة لعلاج هذا الموقف السلبي فقهاً، وقضاءً.
وكذا مسألة الفائدة في التشريع الأردني والتشريعات العربية-وهي ذات صلة بالتعويض عن التأخير-التي احتدم الخلاف حول علاجها تشريعاً وقضاءً وفقهاً. كما وفي هذا الكتاب إشارة للأحكام التي توسع فيها المشرع الإماراتي في الاستمداد من الفقه الإسلامي، والتي لا مقابل لها في القانون المدني الأردني، وفيه أيضاً موازنة بين القانون المدني الأردني والقانون المدني اليمين، الصادر عام 1992 بعد توحيد اليمنين (الشمالي والجنوبي). وهو أحدث قانون مدني عربي صرح في مستهل أحكامه بأنه مستمد من الفقه الإسلامي.
