عُهِدَ إليّ أن أتولَّى تدريس طلبة الماجستير في الحقوق في جامعة مؤتة في الفصل الثاني من العام الجامعي 2000/2001 مادة الحقوق العينيّة، ووقع الاختيار على أن أتناول مادة "حقوق الامتياز"، وكان سبب اختياري لها يعود إلى: إنَّ حظ هذه المادة من التدريس لطلبة البكالوريوس يكاد يكون ضئيلاً في أغلب الأحيان بسبب أنَّ مادة الحقوق العينيّة التبعيّة كانت تدرَّس عادةً ضمن مادة "الحقوق العينيّة الأصليّة والتبعيّة"، ولأنَّ مفردات هذا المساق كثيرة ولا يمكن أن يستوعبها فصل دراسي واحد، لهذا فإنَّ الوقت المتاح لتناول الحقوق العينيّة التبعيّة يكون غير كافٍ بما يضطر معه مدرِّسو المادة إلى إعطاء لمحات سريعة عنها لا تشبع نهماً ولا تسدّ فراغاً، فكان ترشيح هذه المادة، لتكون مجالاً للدراسة، تلافياً لهذا النقص ولسدّ الفراغ. خلت الدراسات التي تتناول شرح "حقوق الامتياز" على نطاق الوطن العربي ـــ فيما نعلم ـــ من دراسة موازنة بين تنظيم هذه الحقوق في التشريعات الوضعيّة ونظائرها في الفقه الإسلامي، وأردنا من اصطفائها لتدرَّس في مستوى الماجستير فتح الباب بشكل أوسع للتعرُّف أكثر على هذا الفقه الباذخ العطاء، الذي تناول مناحي الحياة الإنسانيّة في شتّى مجالاتها منظماً وهادياً، كما لم يفته أن يساير التطوُّر الزمني وما أحدثه من تغيُّرات اجتماعيّة واقتصاديّة وفكريّة وما تطلَّبه هذا التطور والمسايرة من معالجة لمستجدَّات لم تكن ضمن الواقع العملي فيما غبر من زمان، ومما لم يتصدَّ له السلف الصالح بالمعالجة أو التنويه، وضابطه ـــ أعني الفقه الإسلامي الفذّ ـــ في ذلك، مبادئ الشريعة الإسلاميّة الغرَّاء التي وضعت الشروط الكفيلة بهذه المسايرة. وتفريعاً على النقطة السابقة هدفنا من هذه الدراسة، وبهذا الإطار المنوّه به، أن ندعو أبناءنا طلبة الدراسات العليا أن ييمِّموا وجوههم وجهدهم إلى فتح مغاليق الفقه الإسلامي والتعرُّف على لغته وفهم مصطلحاته وإزالة الرهبة من الولوج في مصادره ومراجعه، والتعوّد على تناول مراجعه "مطولات ومختصرات، متوناً وشروحاً وتذييلات ونحوها"؛ لِيُطِلَّ منها الدارس على مروج غنَّاء لذيذة المجتنى مفعمة بالعطاء الخيِّر.
