إنّ موضوع الزوجية وأحكامها، موضوع من مواضيع الحياة، يمس جانبا هاماً من جوانبها، حيث منه يكون التناسل الذي يبني عليه النسب ومنه تنتج القربى وتترتب الصلات التي لا تنفصم والتي تبنى عليها آثار كثيرة ومتنوعة، ولذا فإن معرفة أحكام الزوجية وآثارها أمراً لا يستغنى عنه بل يحتاج الإنسان إلى معرفتهما اختلف موقعه في المجتمع، سواء كان صغيرا أم كبيرا متزوجا أم أعزبا، ذكرا كان أم أنثى.
وكان عرضي للزوجية وأحكامها وآثارها عند المذاهب جميعا، وقد خصصت هذا الكتاب للزواج والطلاق وأحكامهما ونتائجهما، وبعد عرض رأي المذاهب في المسألة وفي المسائل المختلفة، كنت أربطها بما اخذ القانون من الأحكام، على سبيل المقارنة والتبيين حتى يظهر للقارئ من أين استمد القانون أحكامه، وعلى أي المذاهب اعتمد غير أن هناك بعض المواضيع أغفل القانون ذكرها كاللعان والظهار والايلاء، ولهذا جاء ذكرنا لهذه المواضيع مجملا من غير تفصيل في أحكامها، أما في غيرها فقد نقلنا المسائل الفقهية وأدلتها للقارئ بشكل مفصل، يستطيع أن يتفهم على ما جاء في القانون من النصوص.
وعندما كنا نقارن بين ما نص عليه الفقهاء وبين ما نص عليه القانون، كنا نخالف القانون أحيانا ونناقشه، كما فعلنا في مسألة طلاق التعسف والوصية الواجبة وغيرها ولم تكن مناقشتنا للقانون عن هوى، وأنما بناء على ادلة شرعية نقدمها، وقد بينا رجحان تلك الأدلة، لأن الهدف هو الوصول إلى الحكم الشرعي المدعم بالدليل، حيث الأحكام الشرعية التي تعالج مشاكل الناس، لا يجعل أساسها واقع الناس وما هم عليه من العادات، وإنما أساس الأحكام كتاب الله وسنة رسوله صلى الله عليه وسلم.
ولذا فأقوال فقهائنا مع إجلالنا لعلمهم وورعهم وتقواهم وإقرارنا لهم بالسبق والفضل في بناء هذا الصرح الشامخ من الفقه الفريد في نوعه، إلا أننا نقول أن أقوالهم ليست مسلمات لا تقبل النقاش، وإنما هي آراء إجتهادية، توفق للصواب كما قد يعتريها الخطأ لما يقدم من دليل في كل مسألة، والتزاما بالحكم لا لأنه فلان من الفقهاء وأنما لدليله الذي استند به ذلك الرأي. وعلى أي حال فقد حاولت جهدي أن أعرض وأميز وأرجح، متوخيا الدليل الأقوى والأصوب ما استطعت.
