تسعى هذه الدراسة لبحث مشكلات الإستثمار الأجنبي الناشئة عن غياب وضعف التطبيق السليم لإدارة سياسات الإستثمار أو إنخفاض مستوى وكفاءة وفاعلية القائمين على تنفيذ هذه السياسات وذلك من خلال إبراز أهم المعوقات التي تعترض تدفق الإستثمار الأجنبي سواء كانت معوقات تشريعية أم مؤسسية، وبيان النظام القانوني لحماية هذه الإستثمارات من الناحية الموضوعية والإجرائية، وإبراز الدور الحقيقي لقانون تشجيع الإستثمار والهيئات العاملة على تطبيقه ومدى قيامها بالدور المناط بها لتوفير البيئة الإستثمارية المناسبة للمستثمر.
وتوضيح التناقض الموجود بين الدور المتوقع للإستثمار الأجنبي كما تفترض النظريات الإقتصادية وبين الظروف الواقعية من خلال إبراز أهم الآثار الإقتصادية لهذا الإستثمار.
