لا شك أن تدفق رؤوس الأموال الأجنبية يحتاج إلى تنظيم قانوني ، إذ تعتبر الأداة القانونية هي الوسيلة الأساسية في ضمان حقوق والتزامات كلا طرفي عقد الإستثمار ، الدولة المضيفة والمستثمر الأجنبي لتحقيق الأهداف التي يسعيان إليها .
وفي هذا الكتاب تقدم الباحثة ميساء هشام السامرائي دراسة حول التنظيم القانوني للإستثمار الأجنبي في القوانين العراقية والأردنية، وتفعل ذلك عن طريق تحليل قوانين الإستثمار في كلا البلدين وهما : قانون الإستثمار العراقي رقم 13 لسنة 2006 وتعديلاته ، وقانون الإستثمار الأردني رقم 67 و 68 لسنة 2003 وتعديلاته . لذلك تعتبر هذه الدراسة شاملة لكافة قوانين الإستثمار الأجنبي ، وقد حاولت الباحثة تبيان عوامل الإختلاف والإئتلاف في القوانين الناظمة للإستثمار الأجنبي في كلا البلدين ، فانتظمت الدراسة في ثلاثة فصول : تناول الفصل الأول مفهوم الإستثمار الأجنبي والإجراءات الخاصة بتأسيس المشروع الإستثماري ، وسعى الفصل الثاني إلى تحليل المعوقات التي يواجهها المستثمر الأجنبي ومشروعه الإستثماري ، ويأتي الفصل الثالث والأخير ليكشف من ضمانات الإستثمار الأجنبي خاصة التشريعية منها وطرق تسويتها باعتباره التشريع الأساس الذي ينظم الإستثمار الأجنبي بحسب الإتفاقيات الدولية والإقليمية .
