فإن الإقتصاد العراقي وعلى مدى أكثر من عقدين، كان يعيش في أزمة كبيرة ويعاني من اختلالات هيكلية حقيقية، جراء استنزاف موارده في الحروب، ثم الحصار الإقتصادي الذي ضيّق الخناق عليه، والسياسات الإقتصادية التي اتبعها العراق، وأدّت إلى تهميش دور القطاع الخاص، والإستغناء عن الدور الحيوي الذي تؤديه الإستثمارات الأجنبية، وعبد التغيير الذي حصل في العراق وانتهاجه مبدأ الإقتصاد الحر المنفتح، واتباعه سياسة الترحيب بالإستثمارات الأجنبية، وتقديمه الحوافز والمزايا للمستثمرين وتوفير الحماية القانونية لهم، لذا أصبح من الضروري دراسة هذه الحوافز والحماية القانونية التي يقدمها العراق للمستثمر الأجنبي.
وبناءً عليه، تتيح هذه الدراسة الوقوف على تجارب الدول التي سبقت العراق في هذا المجال للتوصل إلى أفضل الحلول القانونية والإقتصادية، التي تسهم في استقطاب الإستثمار الأجنبي وتوطينه في العراق لتحقيق التنمية المنشودة.
