إن الدولة العراقية اليوم معنية بالإستثمارات الأجنبية وتقوم بنقلة نوعية في العمل على تحسين القوانين الداخلية وتوفير الفرص الإقتصادية والإنفتاح السياسي، وتوفير العوامل الجاذبة للإستثمارات من داخل الدولة وخارجها، حيث إن تدفق رؤوس الأموال الأجنبية على محيط الدولة يؤدي إلى تغذية مركز الإقتصاد الوطني، وبالتالي لا بد من توفير الضمانات اللازمة لتشجيع الإستثمارات الأجنبية.
فالضمانات تجعل متخذ قرار الإستثمار مطمئناً إلى مناخ إستثماري مناسب، والذي يقصد منه الأوضاع القانونية والإقتصادية والسياسية والإجتماعية، ومن أهم التشريعات التي أصدرتها الدولة العراقية: قانون الإستثمار العراقي رقم (13) لسنة 2006، الذي سيكون الجزء الأساسي من هذه الدراسة، كذلك صدر قانون التحكيم التجاري العراقي لعام 2013؛ بالإضافة إلى النظم الوطنية للتأمين على الإستثمارات التي تنشئها الدول المصدرة لرأس المال، والتي تعتبر الضامن القانوني الذي يمثل للإستثمار الأجنبي باعثاً رئيسياً يتدفق عبره رأس المال والخبرة العالمية والفنية، وكل ذلك مرهون بتنظيم قانوني دقيق ومحكم لقواعده وأحكامه مع كفالته لمزايا وضمانات تتيح إيجاد مناخ إستثماري مناسب يجذب الإستثمارات الأجنبية التي غالباً ما تسعى للعائد المجزي والأمان والإستقرار، لهذا جاء موضوعنا موسوماً بالعنوان الآتي: "ضمانات الإستثمار الأجنبي في العراق".
