إن مناسبة إصدار هذا الكتاب، تمثل بما وجدته في بعض البرامج الفضائية، من إستغلال بعض مقدمي أو معدي بعض البرامج، وأحياناً ضيوف حلقاتها، فرصة البث الفضائي والقيام بالقذف والذم والتقريع وسواها من النعوت التي تجعل من كلامهم جريمة يعاقب عليها قانون بلد ما، وينهض السؤال عن الموقف القانوني لهذه الأقوال وأكثر صور هذه الجريمة هي جرائم القذف والسب.
وتعتبر هذه الجرائم من بين جرائم الأعلام التي لا تخرج عن الأصل العام للجرائم من حيث أن الجريمة هي سلوك ناتج عن إرادة آثمة يرصد له القانون عقوبة أو تدبير إحترازي وليس لتوفرها على شرط العلانية بإحدى وسائل العلانية ومنها الإعلام بكل أشكاله، أن يجعلها جريمة ذات طبيعة خاصة أو كيان خاص يقتضي إخضاعها لأحكام خاصة وإستخدامها لوسائل تقنية حديثة متطورة مثل البث الفضائي والتأثير الواسع على الجمهور لا يغير من طبيعتها لأن القانون لا يعتد بالوسائل المستخدمة من حيث التجريم.
وتناول الكتاب هذه الجرائم وبيان أركانها في القانون المقارن مع الإشارة إلى تطبيقات قضائية لبلدان أخرى، ومن ثم طرح إشكالية تنازع القوانين وبيان وجهتي النظر السائدتين في المناخ القانوني العالمي وكذلك آلية تحريك الشكوى مع ذكر بعض الأمثلة العملية، ثم تعريف ماهية البث الفضائي وتميزه عن غيره من المتشابه معه.
