الحقيقة أن النظام التقاضي على درجتين فوائد جمة، وما وجه إليه من نقد مدفوع، ومن ثم فهو محقق الفائدة وضروري لحسن سير العدالة، ويعتبر من أهم الضمانات لتحقيق الحرية الشخصية، ولذلك ليس بدعا أن تسير عليه كل التشريعات، بل إنه يعتبر من أهم المبادىء الأساسية التي يقوم عليها النظام القضائي.
ويتعين لتحقيق الفوائد الجمة لهذا المبدأ أن يقتصر على درجتين، فلا تستأنف أحكام المحكمة الاستئنافية أمام محكمة أعلى منها؛ حتى لا تتأبد الخصومات دون حل يحسمها فتظل الحقوق غير مستقرة، ولقد اعتمد البحث على منهجية مقارنة بالقوانين الأجنبية، خاصة القانون الفرنسي رقم516 لسنة2000 الصادر بتاريخ 15 يونيو 2000، وكذلك قانون الإجراءات الجنائية الإيطالي الجديد، والمقارنة بالشرعية الإسلامية ما اقتض الحال ذلك.ولذلك تم تقسيمه إلى ستة فصول يسبقها فصل تمهيدي بعنوان الأصلاح القضائي؛ لبينان ما هية القضاء، وإصلاح البنيان القضائي، وإصلاح الإجراءات القضائية نحو تحقيق أو أداء العدالة.
فصل تمهيدي ما هية الإصلاح القضائي، الفصل الأول: طرق الطعن في الحكم،الفصل الثاني: ما هية الاستئناف وأساسه، الفصل الثالث: مدى تقبل استئناف الجنايات، الفصل الرابع: نطاق الاستئناف، الفصل الخامس: آثار الاستئناف، الفصل السادس: الحكم في الاستئناف .
