التشريعات في الدول العربية ما زالت قاصرة عن مواكبة التحولات التي حدثت في مفهوم الوقف بإعتباره وسيلة من وسائل تنمية الثروة القومية للبلد، ومعظم الأحكام القانونية التي تنظم عمل الأوقاف صدرت منذ أكثر من نصف قرن.
لذلك نجد الضرورة قائمة لإيجاد تشريعات حديثة تنسجم وروح العصر وغاية المشرع الإسلامي في إستحداث الوقف، ولاحظنا سياسة الدولة تجاه الوقف التي تميل نحو الهيمنة عليه وإفراغه من محتواه المدني أو الأهلي وجعله من مؤسسات الحكومة لأن فيه من الموارد المالية العظيمة التي تعزز ميزانية الحكومة تجاه مطالب الشعب.
ومن الملاحظ أيضاً تعدد المحاكم في تنظيم عمل الأوقاف إذ يتأرجح بين محكمة البداءة ومحكمة الأحوال الشخصية ودواوين الأوقاف وهذا التعدد أدى إلى إرباك العمل وتنظيمه لذلك فإن الكتاب هو دعوة إلى النهوض بالأوقاف تجاه مواكبة التطور وبما يتفق وشرط الواقف ومقاصد الشريعة مثلما تعن الحاجة إلى توحيد المصطلحات والاحكام القانونية والشرعية التي تنظم الأوقاف في البلدان الإسلامية.
لذلك، سيكون الكتاب على عدة فصول الأول يتعلق بنظرة سريعة على مفهوم الوقف وتعريفه وأنواعه في الشريعة وفي القانون والفصل الثاني التولية وأحكامها الشرعية والقانونية مع تطبيقات القضاء العراقي وخاتمة الكتاب.
