تمارس الدولة من خلال أجهزتها القضائية اختصاصاً جزائياً في المسائل التي تدخل ضمن ولايتها بما يطلق عليه الاختصاص الجزائي، فإذا انعقدت الولاية للقضاء الوطني، جرى توزيع اختصاص على جهات قضائية محددة بمقتضى توزيع دقيق بين تلك الجهات ويطلق على القواعد الناظمة له قواعد توزيع الاختصاص في المسائل الجزائية.
وعلى ذلك فإن أعمال قواعد الاختصاص تلك تفترض أن يكون القضاء الوطني مختصاً أصلاً للنظر في الجريمة المرتكبة وأن يكون هذا الاختصاص أمراً مسلّماً به، فإذا اتضح أن الجريمة المقترفة هي من اختصاص قضاء دولة أجنبية فيمتنع البحث عندئذ في نطاق المملكة الأردنية الهاشمية عن المحكمة الجزائية الصالحة للنظر في هذه الجريمة.
وتبعاً لتنظيم أجهزة القضاء الجزائي ومهامه فإذا ما دخلت الجريمة ضمن الاختصاص الجزائي للدولة فتمارس الدولة وظيفتها القضائية عن طريق قضائها الجزائي.
الا أن هذا الاختصاص الجزائي لا يجري على إطلاقه، فلا بد من تحديد اختصاص المحكمة الجزائية بنظر الدعوى العمومية، فتقتصر صلاحية القاضي على أنواع معينة من هذه الإجراءات في حدود معينة، بموجب قواعد يتفرع عنها عدد من المسميات وهي الاختصاص الوظيفي والاختصاص الشخصي والاختصاص النوعي أو الموضوعي والاختصاص المكاني.
وينقسم القضاء الجزائي الى نوعين: قضاء تحقيق وقضاء حكم، وتلك التقسيمات التي أخذ بها القانون الأردني ويطلق عليها قواعد الاختصاص الوظيفي، فوظيفة التحقيق الإبتدائي والاتهام والإحالة وهي وظيفة قضائية أناطها المشرع الأردني بالمدعى العام والنائب العام ورئيس النيابة العامة بمقتضى توزيع دقيق، أما المحاكمة والتحقيق النهائي والحكم فتلك وظيفة يتولاها قضاة الحكم.
