ليس هذا الكتاب عرضاً لمقاربة الفكر السياسي والأخلاقي الإسلامي لمفهوم العدل ، بقدر ما هو محاولة للتفكير في الأسباب التي حالت دون الإرتفاع بهذا المفهوم إلى مستوى النظرية التي يتقاطع فيها السياسي والأخلاقي ، ويغدو على ضوئها الفهم المعقول للإجتماع السياسي الإسلامي أمراً ممكناً . وعندما يتعلق الأمر بالفكر السياسي العربي ، فإن التأليف في موضوع العدل سرعان ما يتخذ طابعاً إشكالياً بحكم التضخم المتزايد في الدراسات التي تناولت التصور الغربي للعدل ، في مقابل ندرة الأعمال التي اتخذت من التصور التراثي لهذا المفهوم موضوعاً لها . وبقدر ما يكشف هذا الوضع عن قلق في مرجعة النظر في هذا المفهوم ، وتمزقها بين قطبي الفكر الغربي المعاصر والتراث العربي الإسلامي ، فإنه يبيّن افتقار هذا الفكر إلى أرضية نظرية صلبة – تنبع من معاناته المزمنة مع راهنه – لمقاربة فكرة العدل من داخل دوائر هذا الراهن وأسئلته الحارقة المتجذرة في تراثه الأخلاقي والسياسي .
ليس التراث الإسلامي ملكاً لأحد ؛ هو ليس ملكاً للقراءة الأصولية التي عملت على تسويره واحتكار تأويله منذ عقود طويلة ، ولا ملكاً لغيرها من القراءات التي قدمها المستشرقون والدارسون الغربيون ، أو غيرهم من أصحاب المشاريع الفكرية الكبرى المؤثثة لمشهد الفكر العربي المعاصر . كما أن تحرير التراث لا يعني انتزاعه من أيدي الأصولية الإسلامية والزجّ به في قبضة أصولية ( أو أصوليات ) من نوع جديد ، طالما أن تملّكه لا يعني امتلاكه وحيازته . فلا بد من شق دروب مختلفة في البحث عن معنى التراث السياسي الإسلامي ومساءلته على ضوء الأسئلة التي ما انفك الراهن يطرحها عليها ، وقد كان الإنصات لنصوص الفقهاء ، ومحاولة الوعي بعلاقتها القلقة والمتوترة بواقع المُلك ، أهم سمات القراءة التي نقدمها في دراستنا لمفهوم العدل في الفكر الإسلامي الكلاسيكي .
