العدالة في اللغة العربية هي العدل، ويعني هذا الأخير ما استقام في النفس وما كان نقيضاً للجور، والعدل اسم للخالق ومعناه أن لا يميل به الهوى فيجور في الحكم، والإنسان العدل هو الشاهد الذي تعتمد شهادته، والعدل هو كذلك الفدية والمساواة والموازنة والتقويم... والعدل هو الحكم بالحق، والحق في اللغة العربية هو نقيض الباطل وهو الباطل والصواب والحقيقة واليقين.
وتعتمد العدالة على عدة قواعد مصدرها الدستور والمعاهدات والقوانين والنصوص التنظيمية والأحكام القضائية التي تتعلق بحلول وضعيات قانونية معينة؛ أما الحق فهو من جهة الملكة التي تمكن الإنسان من إستيعاب فعل معين والتمتع بشيء معين والزعم بإمتلاكه والمطالبة به، وهو من جهة ثانية ما يخول للفرد الإستفادة من شيء ما أو إستعماله أو إنتاجه.
يمكن لهذه التعريفات أن تحدد المعالم الأساسية للإشكال المعالج الذي يتمحور حول علاقة الحق بالقوة وتأثير تلك العلاقة على العدالة وعلى الأهداف الفعلية من تطبيق القانون وإحترامه؛ وفي مقابل ذلك يتبوأ الحق مكانة سامية في حقل الأخلاق والإلتزام والسلوك الطوعي.
تقترح النصوص المختارة والمقدمة في هذا الكتاب إنارة هذا الإشكال وتعميق التفكير في جميع مكوناته.
