الدستور: مجموعة من القيم السياسية، والفلسفية، والإقتصادية، والإجتماعية، وغيرها... تؤمن بها الجماعة في زمان، ومكان معينين فيُلزم المشرع الدستوري على نقلها من حيز الضمير، والوجدان إلى عالم المحسوس والمدرك في وثيقة مطولة أو مقتضبة، تعلو على الممسكين بزمام السلطة، وغيرهم، وتسمو على أعمالهم وأفعالهم.
لذا، فالدساتير تخرج بمظهرين: موضوعي، وشكلي، أما المظهر الموضوعي: فهو القيم، أعلاه، التي أرادت الجماعة إلزام بها، أما المظهر الشكلي: فهو الشكل أو الصيغة التي أظهرت تلك القيم، ويعبر عنها بالصياغة أو ما سنعمد على تسميته، بهذه الدراسة، ببناء النص الدستوري.
ويتقدم البحث في تفسير الدساتير إجلاء مساوئ صياغتها، وعوار بنائها، ومثالب نقل القيم من وجدان الجماعة إلى وثيقة الدستور، بل إن موجبات التفسير تنتج من تقهقر النصوص عن قدرتها على مواكبة المستحدثات والمتغيرات، فالدساتير بحسبان أنها وثائق تقدمية مستقبلية لا ترتد في تطبيقها إلى نطاق زمني غابر، ولا يتراجع نطاق تطبيقها إلى فترة زمنية مرت أو لقيم غادرتها الجماعة وولت، بل، على العكس، تتعايش مع الحاضر، وترمق المستقبل بطرفها.
