إن مشكلة حقوق الإنسان وحرياته تكمن في مجال ضمانتها وكفالتها. فبعد أن تم وضع أسس وركائز حقوق الإنسان وحرياته والدفاع عنها، وبعد أن أصبح إنسان اليوم متمتعاً لهذه الحقوق عارفاً لحدودها. لذا لم تعد هناك حاجة إلى تذكير الناس بأهمية تلك الحقوق الحريات بوصفها جزء من كيانهم البشري منحهم إياها الله قبل تدوينها في المواثيق الدولية والدساتير. ورغم أن الدساتير أقرت تلك الحقوق والحريات إلا أن ما يتم إعطاؤه بيد، يتم سحبه بيد أخرى فالحقوق والحريات المقررة تشكل دستوري يقوم المشروع العادي بسحبها عند تنظيمه لها بمقتضى الإجازة الدستورية سواء أكان ذلك في ظل الظروف العادية أم في ظل الظروف الاستثنائية.
والغاية من هذا الموضوع، فإنها تتمثل في التعرف على مدى توافر الضمانات لحقوق الإنسان وحرياته في الدساتير العربية، ومدى كفاءتها لضمان حقوق الإنسان وحرياته.
وقد اعتمدنا أسلوب التحليل والنقد لما ورد في بعض الدساتير العربية من مواد بشأن التنظيم لضمانات حقوق الإنسان وحرياته، لتسليط الضوء على هذه النصوص واستجلاء معانيها ومقاصدها وتتيح تطبيقها وصولاً إلى معرفة صلاحية هذه المواد وملاءمتها للأغراض التي شرعت من أجلها.
وقد وضعنا خطة تعتمد على تقسيم هذه الرسالة إلى أربعة فصول هي:- الفصل الأول: حقوق الإنسان وحرياته، تطورها التاريخي وأنواعها، وضماناتها، الفصل الثاني: الضمانات الدستورية، الفصل الثالث: الضمانات القضائية، الفصل الرابع: الضمانات السياسية، وسننهي هذه الدراسة بخاتمة تتضمن أهم الاستنتاجات التي توصلنا إليها.
