"الدستور" وثيقة تتضمن مجموعة من الرؤى السياسية، والإجتماعية، والإقتصادية السائدة في مجتمع معين فضلاً عن تضمنها للحقوق، والحريات التي آمن بها المشرع الدستوري، وضمنها الوثيقة الدستورية، وتتعرض النصوص الدستورية بالرغم من عُلُوها، وَسموها على النصوص التشريعية النافذة في الدولة كافة إلى عدم التطبيق أو التعطيل حيناً، أو لسوء التطبيق أو الإنحراف عن المقاصد التي سعى نحوها المشرع الدستوري حيناً آخر.
تتصف هذه الدراسة بالصفة النظرية العلمية المستندة إلى الآراء الفقهية الدستورية، وعدد من المقاربات مع الدستور الألماني لسنة 1949م النافذ، ودستور جنوب أفريقيا لسنة 1996م النافذ نظراً لتشابه ظروف وضعهما مع ظروف وضع الدستور العراقي فضلاً لتضمنهما مضامين، وقيم دستورية متقدمة، مستندين إلى النسخة الإنكليزية لهما، والصفة التطبيقية العملية التي تستند إلى إتجاهات المحكمة الإتحادية العليا في تفسير الدستور العراقي.
لذا ستقسم الدراسة إلى بابين رئيسين؛ أما الباب الأول: فخصص للنظرية العامة في التفسير الدستوري، الذي قسمه إلى فصول خمسة تتضمن: معنى التفسير ونطاقه، ومذاهب التفسير الدستوري، وجهات التفسير الدستوري، وأسباب التفسير الدستوري، وسائل التفسير الدستوري؛ أما الباب الثاني: فخصص للمحكمة الإتحادية العليا، وإتجاهاتها، ومذاهبها في التفسير الدستوري، الذي قسم إلى فصول أربعة تتضمن: تأسيس المحكمة الإتحادية العليا، وإختصاصاتها، وقنواتها التفسيرية، وصفات قراراتها، وتكيّفها القانوني، وإجراءاتها في التفسير الدستوري.
