لقد شرع الله للبشر العدل والإحسان والإخاء وأمرهم بعمارة الأرض.. وجاءت الشريعة الإسلامية الغراء والأديان السماوية الأخرى فأقامت نظاماً إنسانياً متكاملاً حينما وضعت القواعد القانونية التي تحفظ حقوق مقاتلي وضحايا النزاعات المسلحة والمدنيين والمواقع المحمية، وتفرض القيود على سلوك المقاتلين في الميدان على استخدام الوسائل العسكرية.
غير أن الأطراف المتحاربة لم تراع تلك القواعد التي جاءت بها للحد من النزاعات المسلحة والهجمات العشوائية أو المذابح، وكانت قاعدة القوة مصدر الحق المعروفة باسم شريعة الغاب هي التي تسود، ولعل ما تكبدته البشرية من خسائر في الحرب وبخاصة الحربين العالميتين الأولى والثانية التي راح ضحيتها أكثر من عشرات الملايين يشير إلى أن الحرب حالة واقعية لا يمكن تجنبها لأنها استجابة للغريزة الإنسانية الشريرة الدافعة إلى التنازع، بل إن تاريخ البشرية بحيرة دموية تتخللها جزر بيضاء بنسبة 1 سلام إلى 10 حروب ودماء.
..حتى الحرب لها حدود... قول تبرز أهميته من خلال إلزامية منع انتهاكات القانون الدولي الإنساني ومحاكمة المسؤولين عنها وصولاً إلى العمل الإنساني حيال الضحايا.. مدنيين وعسكريين. والمواقع المدنية والأعيان المحمية بما فيها موارد المياه والمنشآت المائية.. كما تبرز أهميته من خلال تحديد مسؤوليات الدول المتنازعة.
وفي محاولة للإجابة عن كثير من التساؤلات التي طرحت في مجال الحماية الدولية لموارد المياه والمنشآت المائية أثناء النزاعات المسلحة جاءت فكرة الكتاب ليعرض حالات تطبيقية شتى منها: نشأة القانون الدولي الإنساني وتطوره وقواعده الأساسية والحماية المقررة لموارد المياه والمنشآت المائية وواجبات القادة في الميدان إزاء الحماية الدولية للموارد والمنشآت المائية والآثار القانونية المترتبة على انتهاك قواعد الحماية الدولية لهذه الموارد والمنشآت المائية.
