لطالما طرحت النزاعات المسلحة تحديات كبيرة أمام المجتمع الدولي، ولطالما دفع المدنيون ثمن النزاعات سواءاً الداخلية أم الدولية، ثمن دفعته البشرية على مراحل عبر التاريخ، وخسائر تكبدتها الإقتصادات العالمية بشكل لا يعد ولا يحصى.
وبالرغم من جهود المجتمع الدولي للحد من النزاعات المسلحة والتخفيف من ويلات الحروب على المدنيين، إلا أن الظروف الجيوسياسية، وتحكم القوى العظمى بمصير الشعوب، لم تسمح بحد نوع وكم النزاعات المتنقلة،، لا بل ساهمت عوامل عديدة، أبرزها إنتشار العولمة والخصخصة، وتشابك المصالح السياسية إلى ظهور أنواع جديدة من النزاعات، فرضت نفسها في الألفية الجديدة، وأبرزها النزاعات عبر الوطنية، والتي لا ينتمي أعضاءها إلى حدود معينة كتنظيم القاعدة، حركة طالبان، تنظيم الدولة الإسلامية في العراق والشام "داعش".
حركات وتنظيمات تنتقل بين حدود الدول مهددة السلم والأمن الدوليين، ولعل هذه النزاعات والتي عجز القانون الدولي حتى اليوم من دراستها وتحليلها، وصياغة القواعد التي تحكمها، تهدد مصير المدنيين، وتجعلهم في مهب الفوضى الخلاقة التي تنتشر داخل الخريطة العالمية.
